1. Acceptance of Terms
By accessing or using WaterLands ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
WaterLands provides real-time river condition monitoring, flow data, and related tools for anglers and water enthusiasts. Data is sourced from public agencies including USGS and NOAA. We do not guarantee the accuracy, completeness, or timeliness of this data.
3. User Accounts
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 13 years old to use the Service
- One person may not maintain more than one account
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Scrape, crawl, or use automated means to access the Service without permission
- Interfere with or disrupt the Service or its infrastructure
- Impersonate any person or entity
- Use the Service to send spam or unsolicited messages
5. Intellectual Property
The Service, its design, code, and branding are owned by WaterLands. River data from public agencies remains in the public domain. User-generated content (spots, fishing logs, community posts) remains owned by the user, but you grant WaterLands a license to display it within the Service.
6. Paid Features
Some features may require a paid subscription. Payments are processed by Stripe. Refund policies will be communicated at the time of purchase. We reserve the right to change pricing with reasonable notice.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. River conditions are inherently dangerous and unpredictable. WaterLands does not guarantee the accuracy of flow data, conditions, or safety ratings. Always exercise independent judgment and caution when on or near water.
8. Limitation of Liability
WaterLands shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. This includes, but is not limited to, personal injury, property damage, or loss of data. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through your account settings.
10. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify registered users of material changes via email.
11. Governing Law
These terms are governed by the laws of the State of Colorado, United States.
